Getting married in Australia

So that big question has been popped; CONGRATULATIONS! So… what’s next?

Lucky for us, getting married in Australia is relatively easy and stress-free; here is what you need to know.

 

Once your date is set, you must complete and lodge your Notice Of Intention to Marry (NOIM). 

 

This form must be in my hot little hands at least one month before your wedding. The earlier, the better, but no earlier than 18 months before your wedding day. *Need to get married within 1 month? – See Shortening of Time below.

 

I will send you this form and go through it with you to ensure all details are correct, or you can download the form here.

I will also need to sight your Identification to authenticate the information; acceptable forms of Identification are: 

  • Passports 
  • Birth Certificate and Drivers Licence

 

Proof of end of previous marriage papers is also required:

  • Divorce certificate 
  • Death Certificate 

Don't have a month to spare - shortening of time

In certain circumstances, the one-month requirement can be waived. However, you will need to be able to provide proof of requiring the time to be shortened.

 

Some circumstances that can be considered would be a terminal illness, moving to another country, or a celebrant error in completing the NOIM. These are a few examples and the Prescribing Authority reviews every case.

 

You will need to complete the NOIM and have it signed by your celebrant, and the Application will need to be submitted to the Authority granting the Shortening of Time (Births, Deaths, and Marriages).

An additional charge is also required to apply for this.

Declaration of no legal impediment

This Declaration form is the following form that must be signed before your wedding ceremony. It is best to have it signed at your rehearsal, but it can also be signed on the day of your wedding, so long as it is before the wedding is solemnised.

 

This Declaration form is a Declaration that there is no legal reason why you can not be married; you will declare that you are not married to anyone else. That you are not in a prohibited relationship – No brothers and sisters! That you are of marriageable age and that you are there ready to be married of your own free will.

Marriage certificate

On the day, you will then get to sign two Official Marriage Certificates, one for Births, Deaths, and Marriages and one for the celebrant to keep. You will also sign your Form 15, the Commonwealth Marriage Certificate, and you get to take that home with you!

Overseas couples getting married in Australia

Are you living overseas but wanting to get married on our beautiful shores? Picture yourself by the beach with the sand between your toes or get married at one of our picturesque wineries in the Swan Valley, or why not even get married in the caves at Yanchep?

 

I can definitely get you married here, but here are a few things you need to know first. 

 

The Notice of Intention to Marry (NOIM) needs to be completed by you in your Country – you can download the form here, or I can email it to you. 

You will need to print it out and have it signed by an Authorised witness and then emailed back to me so it can be officially lodged, however, I will need to sight the original before the wedding. 

 

A list of people that can sign your document: 

  • An Australian Diplomatic Officer 
  • An Australian Consular Officer 
  • A Notary Public 
  • An Employee of the Commonwealth authorised under the Consular Fees Act 1955
  • An Employee of the Australian Trade Commission authorised under the Consular Fees Act 1955 

After the form has been lodged along with ID and any supporting documents, we can plan how to make this an epic trip to Aus!

Visa Letters – If you require a Visa letter, I can provide you with one; you will still need to Lodge your NOIM and have a date set. I can then send you a Visa letter.
